Do Not Call Registry
One of the first and most important steps West Virginia residents can take to reduce unwanted telemarketing calls is to register their phone numbers on the National Do Not Call Registry. The registry is designed to help consumers limit sales calls from telemarketers and provide an additional layer of legal protection against unwanted solicitations. If you believe you may have already signed up, it is still a good idea to verify your registration to ensure your number remains active and protected.
The Do Not Call Registry serves as a first line of defense against persistent telemarketing calls. Once your number has been registered for at least 31 days, most telemarketers are prohibited from contacting you. If they continue to call after that period, they may be violating federal law and could potentially face penalties. In some situations, consumers may also have the right to pursue legal remedies against companies that ignore these restrictions.
Registration on the Do Not Call Registry is completely free. Both landline and mobile phone numbers can be added to the registry, making it accessible for nearly everyone. Consumers in West Virginia can register online or by phone. After registering, it may take up to 31 days before telemarketing calls begin to decrease because businesses are given time to update their contact lists. Once that period has passed, however, most unsolicited sales calls become illegal.
It is important to understand that not every type of organization is restricted by the Do Not Call Registry. Certain callers are exempt under federal law. These exemptions commonly include charitable organizations, political campaigns, survey and polling companies, debt collectors, and businesses with which you already have an established relationship. Even though these organizations may legally contact you, they are still generally required to stop calling if you specifically request that they do so.
For example, if a charity repeatedly contacts you seeking donations, you can tell the representative to place your number on the organization’s internal do-not-call list. The same is true for many businesses and organizations that may otherwise be exempt. Once you clearly instruct them to stop calling, continued contact may create legal liability.
Consumers should also be aware that scammers and illegal robocall operations often ignore the law entirely. Many fraudulent callers use spoofed phone numbers to disguise their identities or make it appear that the call is coming from a local West Virginia number. Because of this, it is important to remain cautious when answering unknown calls and to avoid sharing personal or financial information over the phone unless you are certain of the caller’s identity.

Handling and Documenting Unwanted Calls
In addition to registering your number, one of the most effective ways to protect yourself from unwanted calls is to carefully document every suspicious or harassing communication you receive. Proper documentation can help establish patterns of misconduct, support complaints filed with regulatory agencies, and strengthen any legal claim you may later decide to pursue.
Start by keeping a written log of every unwanted call you receive, even if you do not answer the phone or recognize the number. Include the date and time of each call. Consistent recordkeeping can demonstrate how often the calls occur and whether they continue after you requested that they stop.
If the caller leaves a voicemail, save it. Do not delete messages, even if they seem insignificant at first. Voicemails may later serve as evidence showing the nature of the call, the identity of the caller, or the type of language that was used. Some callers make threats, provide misleading information, or continue contacting consumers after being told to stop, all of which may become important evidence.
If caller ID information appears on your phone, write down the displayed number and any identifying name connected to the call. Keep in mind that scammers sometimes use fake or spoofed numbers, but recording the information can still be useful for investigators and attorneys.
When you answer an unwanted call, try to gather as much information as possible. Record the name of the caller, the name of the company they claim to represent, and any employee identification or badge number they provide. You should also make notes about the content of the conversation, including any threats, sales tactics, or misleading statements made during the call.
West Virginia consumers who receive unwanted calls on their cell phones should also keep copies of their phone bills and call records whenever possible. These records may help establish the volume of calls received and demonstrate whether the calls resulted in charges or disruptions.
Documenting unwanted calls is extremely important because it creates evidence that may later support a complaint or lawsuit. In some cases, consumers may be entitled to compensation under federal consumer protection laws such as the Telephone Consumer Protection Act. Detailed records can help establish when the calls occurred, how frequently they happened, and whether the caller ignored requests to stop.
If the caller is a legitimate business or organization, you should clearly state that you do not wish to receive any additional calls at that number. Be direct and specific. Ask to be placed on the company’s internal do-not-call list and record the date when you made the request. Once you have instructed the caller to stop, continued calls may create additional legal consequences for the company.
However, if the call itself was illegal from the beginning, such as certain robocalls made without consent, you may not be required to provide notice before taking legal action. Because telemarketing and robocall laws can be complicated, consumers dealing with repeated unwanted calls may benefit from speaking with an attorney familiar with consumer protection laws in West Virginia.
